The European "Third Way": Neither Wild West nor State Control
The US model is libertarian chaos. The Chinese model is authoritarian surveillance. Europe is building a Third Way for AI: Human-Centric, Regulated, and Sovereign.
The Question Nobody Asked Until It Was Too Late
In 2004, Mark Zuckerberg launched Facebook from his Harvard dorm room. In 2005, YouTube went live. In 2007, the iPhone revolutionized mobile computing. In 2008, Satoshi Nakamoto published the Bitcoin whitepaper. In 2012, ImageNet proved deep learning could achieve superhuman performance.
During this period of explosive technological change, a crucial question went almost entirely unasked: What kind of society do we want this technology to create?
The engineers and entrepreneurs building these systems were focused on capability. Could they make the network faster? Could they make the algorithm smarter? Could they make the platform more engaging? Success was measured in users, transactions, compute cycles, and stock price.
The question of values was considered someone else's problem. Or it was assumed the market would sort things out. Or it was dismissed as the concern of Luddites who simply didn't understand the technology.
Two decades later, we live with the consequences of that oversight. A generation of teenagers struggles with mental health crises exacerbated by addictive social media algorithms. Democratic elections have been manipulated by foreign adversaries using the same targeting tools designed to sell advertising. Entire populations are under constant surveillance, their every movement and transaction catalogued by governments and corporations alike.
The question wasn't asked, so the answer emerged by default. And the default answer was shaped by whoever moved fastest and cared least about the externalities.
The Two Dominant Models: Different Failures
As AI emerges as perhaps the most transformative technology since electricity, the question of values can no longer be avoided. And currently, two dominant models compete for global influence. Both have failed in different ways.
The American Model: Surveillance Capitalism
The American approach to technology governance can be summarized in a phrase: let the market decide, and regulate (maybe) after problems emerge.
This model produced extraordinary innovation. Silicon Valley created some of the most successful companies in human history. American tech giants dominate global markets. The entrepreneurial energy and venture capital ecosystem have no parallel anywhere in the world.
But the model also produced extraordinary harms. When your business model depends on maximizing user engagement to sell more targeted advertising, the algorithm doesn't care whether that engagement comes from connecting people with their communities or from stoking outrage and division. The incentives are structurally misaligned with human welfare.
Social media platforms optimized for engagement discovered that anger spreads faster than truth. Recommendation algorithms learned that conspiracy theories generate more clicks than factual reporting. Advertising systems found that micro-targeted political manipulation is just another revenue stream.
The American model treats these as unfortunate side effects that might eventually be addressed by market forces or, perhaps, belated regulation. But the harms are not bugs in the system. They are features. They emerge directly from the structural incentives of surveillance capitalism: extract maximum data, maximize engagement, and externalize the societal costs.
The Chinese Model: Digital Authoritarianism
The Chinese approach represents the opposite extreme. Here, the state doesn't regulate technology; it directs it. Technology exists to serve the interests of the Chinese Communist Party.
This model has also produced impressive results in narrow terms. China leads in facial recognition, autonomous vehicles in controlled environments, and manufacturing automation. When you can deploy surveillance infrastructure without worrying about privacy concerns, certain kinds of development become much easier.
But the model has produced a society under constant surveillance. The Social Credit System tracks citizen behavior and restricts opportunities for those deemed insufficiently loyal. The Great Firewall ensures that Chinese citizens cannot access information the Party considers dangerous. AI-powered surveillance enables the persecution of ethnic minorities at industrial scale.
For those outside China, the export of this model is equally concerning. Chinese technology companies sell surveillance infrastructure to authoritarian governments worldwide. The Digital Silk Road extends not just fiber optic cables but a vision of technology as a tool of social control.
Europe Awakens: The GDPR Precedent
For the first two decades of the digital revolution, Europe seemed like a bystander. American companies built the platforms. Chinese companies manufactured the hardware. Europeans were consumers, not creators. Rule-takers, not rule-makers.
The turning point came with the General Data Protection Regulation, which took effect in 2018. GDPR was initially dismissed by Silicon Valley as bureaucratic overreach that would never be enforced. They were wrong.
GDPR established several revolutionary principles that are now reshaping global technology development:
- Privacy as a fundamental right, not a preference that can be waived with a click on a terms-of-service agreement
- Purpose limitation: data collected for one purpose cannot be used for another without explicit consent
- Data minimization: collect only what you need, and keep it only as long as necessary
- Right to explanation: people have the right to understand how automated decisions affecting them are made
- Right to erasure: the famous "right to be forgotten"
What made GDPR transformative was not just the principles but the enforcement mechanism. Fines of up to 4% of global annual revenue got the attention of even the largest tech companies. And because Europe represents a market of 450 million affluent consumers, companies couldn't simply ignore the rules.
The result was the "Brussels Effect." Rather than maintain separate products for Europe and the rest of the world, many companies implemented GDPR-compliant practices globally. European regulation became the de facto global standard.
The AI Act: Codifying the Third Way
The EU AI Act, which entered force in 2024 with phased implementation through 2027, represents the most ambitious attempt yet to govern artificial intelligence. It codifies the European Third Way for the AI era.
The Act's genius lies in its risk-based approach. Rather than treating all AI the same, it creates categories:
- Unacceptable Risk (Banned): Social scoring systems, real-time remote biometric identification in public spaces, manipulation of vulnerable groups, AI that exploits human weaknesses
- High Risk (Heavily Regulated): AI in critical infrastructure, education, employment, essential services, law enforcement, migration, justice systems
- Limited Risk (Transparency Required): Chatbots, emotion recognition systems, content recommendation algorithms
- Minimal Risk (Unregulated): AI-enabled video games, spam filters, most consumer applications
For high-risk systems, the requirements are substantial: risk management systems, high-quality training data with documented provenance, logging and traceability, human oversight mechanisms, accuracy and robustness testing, and conformity assessments before deployment.
Critics call this approach burdensome. They argue it will slow innovation and drive AI development to less regulated jurisdictions. But this criticism misunderstands what the Third Way is trying to achieve.
Why Regulation Creates Competitive Advantage
Consider the aviation industry. Building aircraft is heavily regulated. You cannot simply construct a plane in your garage and start carrying passengers. Every component must meet exacting standards. Every process must be documented. Every failure must be investigated.
Has this regulation killed aviation innovation? Obviously not. The industry has evolved from the Wright Brothers to the Boeing 787 to reusable rockets. Regulation didn't prevent innovation; it channeled innovation in directions that maintained public trust.
It is precisely because aviation is extraordinarily safe that billions of people are willing to fly. If planes crashed as often as software crashes, the airline industry would not exist. The regulation creates the trust that enables the market.
AI is now entering domains where the same logic applies. When AI systems manage medical diagnoses, financial decisions, and transportation infrastructure, users will demand the same level of reliability assurance they expect from aviation. "Move fast and break things" is not an acceptable approach when the thing being broken might be a patient's health or a family's financial security.
By establishing clear standards early, Europe is creating a market for "Premium AI" that meets higher reliability and ethical standards. This is not a constraint on innovation. It is a specification for a new category of product that the market is beginning to demand.
Digital Sovereignty: The Strategic Imperative
Beyond individual rights and market trust, the European Third Way addresses a strategic imperative: digital sovereignty.
The pandemic revealed Europe's vulnerability when supply chains for medical equipment ran through China. The Ukraine war revealed Europe's vulnerability when energy supply ran through Russia. The same vulnerability exists in technology.
If European critical infrastructure depends on American cloud providers, European data resides on American servers subject to American law, and European AI systems run on chips manufactured in Taiwan or controlled by American export restrictions, then Europe's digital future is subject to foreign veto.
This is not hypothetical. The CLOUD Act gives American authorities the ability to demand data from US-based cloud providers regardless of where that data is physically stored. Export controls can restrict which chips are available. Terms of service can change overnight, as countless businesses discovered when various American platforms modified their policies.
True sovereignty requires technical independence. This means European cloud infrastructure, European semiconductor manufacturing (the CHIPS Act is a start), and European AI systems that don't depend on foreign control planes.

Japan has adopted privacy frameworks influenced by European standards. California, home of Silicon Valley, has implemented state-level privacy regulations that follow European precedents.
But China is also exporting its model. Through the Belt and Road Initiative and Digital Silk Road, Chinese technology companies are building infrastructure in Africa, Southeast Asia, and Latin America. Along with the infrastructure comes the surveillance architecture and the governance model.
The question is which vision of technology's role in society will become the global default. Will it be the American model where users are products to be monetized? The Chinese model where citizens are subjects to be monitored? Or the European model where people are citizens with rights that technology must respect?
The Economic Opportunity in the Third Way
Some argue that Europe's regulatory approach will inevitably disadvantage European companies competing against less regulated American and Chinese rivals. But this assumes that the future of AI looks like the present: winner-take-all platforms built on surveillance.
We see a different future. As AI moves into critical infrastructure, healthcare, financial services, and physical automation, the tolerance for unreliable, unexplainable systems will decrease, not increase. The market will demand what Europe is already requiring.
Consider the enterprise market. Large organizations don't want AI that might hallucinate answers or make decisions they can't explain to regulators. They don't want systems that might violate privacy laws and generate billion-euro fines. They don't want dependencies on foreign providers that could be weaponized through export controls or sanctions.
What they want is exactly what European regulation encourages: reliable, explainable, sovereign AI that they can trust with their most sensitive operations.
Europe is not regulating itself into irrelevance. Europe is defining the specifications for the AI systems that the enterprise market actually needs. Companies that can meet these specifications will have access to the most demanding, highest-value market segments globally.
The Path Forward: Values as Competitive Advantage
The next decade will determine whether AI amplifies human flourishing or accelerates human manipulation and control. The outcome is not predetermined. It depends on choices being made now.
The European Third Way represents a bet that values and innovation are not opposites. That privacy and capability can coexist. That regulation and progress can reinforce each other. That technology can serve human dignity rather than undermining it.
